This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of domain name https://www.wishkr.com ('Website'), including the related mobile site and mobile application (hereinafter referred to as 'Platform').

The Platform is owned and operated by Wishkr, a sole proprietorship having its principal place of business at Floor 0, Sr No 167, Plot no 15, Kamgarnagar, Pimpri, Pune, Maharashtra - 411018, India (hereinafter referred to as 'Platform Owner', 'we', 'us', 'our').

For the purpose of these Terms of Use, wherever the context so requires, 'you', 'your' or 'user' shall mean any natural or legal person who has agreed to become a user/buyer on the Platform.

ACCESSING, BROWSING OR OTHERWISE USING THE PLATFORM INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE TERMS OF USE, SO PLEASE READ THE TERMS OF USE CAREFULLY BEFORE PROCEEDING.

1. Acceptance Of Terms

Welcome to Wishkr. By accessing our website, contacting us on WhatsApp, placing an order, creating an account, or using our platform and related services, you agree to these Terms & Conditions.

If you do not agree to these Terms, please do not use Wishkr.

Wishkr may update these Terms from time to time at any time without assigning any reason. It is your responsibility to periodically review these Terms to stay informed of updates. Continued use of Wishkr after changes are posted constitutes acceptance of the updated Terms.

Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials offered on this Platform or through the Services, for any specific purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law. You agree to pay us the charges associated with availing the Services.

2. About Wishkr

Wishkr is an occasion-led gifting platform that helps customers discover, select, purchase, and arrange delivery of gifts such as digital gift cards, curated hampers, custom gifts, personalized products, cakes, flowers, chocolates, experiences, decorations, and partner-fulfilled products.

Wishkr may fulfil some orders directly and may coordinate other orders through third-party fulfilment partners, gift card providers, vendors, delivery partners, courier partners, and payment service providers.

3. Eligibility

To use Wishkr, you must be at least 18 years of age and have the legal capacity to enter into a binding agreement.

By using Wishkr, you represent and warrant that you meet these eligibility requirements.

4. User Accounts

You may be required to provide account, contact, recipient, delivery, gifting, or payment-related information while using Wishkr.

  • You are responsible for maintaining the confidentiality of your account information.
  • You agree to provide accurate, complete, and updated information.
  • You are responsible for all activities that occur under your account or through your submitted details.
  • You must notify us immediately if you suspect unauthorized use of your account or information.

5. Use Of Our Services

You agree to use Wishkr only for lawful purposes and in accordance with these Terms.

You agree not to:

  • Use Wishkr for any unlawful, fraudulent, or unauthorized purpose.
  • Provide false, incomplete, misleading, or inaccurate information.
  • Interfere with or disrupt Wishkr, its servers, systems, or security.
  • Attempt to gain unauthorized access to any part of Wishkr.
  • Use Wishkr to send spam, harmful content, abusive content, or unsolicited messages.
  • Misuse offers, discounts, refunds, gift cards, or platform features.
  • Resell, copy, or commercially exploit any part of Wishkr without our written consent.

Wishkr may refuse, cancel, hold, or investigate any order if we suspect fraud, misuse, incorrect information, payment issues, unavailability, operational risk, or violation of these Terms.

6. Customer Responsibilities

Customers are responsible for providing correct and complete information, including:

  • Name.
  • Phone number.
  • Email address, if required.
  • Recipient details.
  • Delivery address.
  • Delivery date and delivery instructions.
  • Gift message.
  • Customization details.
  • Occasion details.
  • Any product restrictions, preferences, or allergies where relevant.

If delivery, fulfilment, personalization, or communication fails due to incorrect or incomplete information provided by the customer, refund, replacement, redelivery, or cancellation may not be guaranteed.

7. Orders And Payments

All prices are listed in Indian Rupees (INR) unless otherwise stated.

Orders are confirmed only after successful payment and acceptance by Wishkr or the relevant fulfilment partner.

Payments may be collected through payment gateways, UPI, payment links, cards, or other approved payment methods.

Prices, discounts, offers, availability, delivery timelines, and partner terms may vary by gift type, location, date, fulfilment partner, and operational conditions.

Wishkr uses third-party payment processors and does not store full debit card details, credit card details, CVV, banking passwords, or UPI PIN information.

Order confirmation does not guarantee fulfilment or delivery. Wishkr reserves the right to cancel or refuse orders in case of pricing errors, stock unavailability, service unavailability, payment failure, suspected fraud, incorrect information, or operational issues.

8. Digital Gift Cards And Vouchers

Digital gift cards and vouchers may be issued by third-party providers, brand partners, or gift card platforms.

Gift cards and vouchers are subject to the terms and conditions of the respective issuing brand or provider.

Once issued or delivered, digital gift cards and vouchers are generally non-cancellable, non-returnable, and non-refundable unless there is a proven issue such as failed issuance, duplicate payment, invalid voucher, or wrong voucher caused by Wishkr or its fulfilment partner.

Wishkr is not responsible for brand-specific redemption issues, expiry rules, usage restrictions, balance policies, or changes made by the issuing brand after the voucher is issued.

9. Custom Gifts, Hampers And Personalized Products

Custom hampers, personalized gifts, branded gifts, printed products, engraved products, made-to-order products, and similar customized items may be prepared based on the customer's requirement.

Once confirmed, sourced, customized, packed, prepared, or dispatched, such orders may not be eligible for cancellation, return, or refund except in verified cases of non-delivery, wrong item, damage, missing item, or material mismatch from the confirmed order.

10. Perishable Gifts

Flowers, cakes, chocolates, food items, fresh products, and other perishable gifts are subject to availability, preparation timelines, delivery conditions, and partner policies.

Perishable items are generally non-returnable once prepared, packed, dispatched, or delivered, except in verified cases such as wrong item, non-delivery, damage, or spoilage reported within the applicable support window.

11. Experiences And Bookings

Experience-based gifts, private theatre bookings, event-based gifts, reservations, and similar services are subject to partner availability, slot availability, partner rules, and partner cancellation or rescheduling policies.

Wishkr will help coordinate such bookings, but final fulfilment depends on the relevant partner.

No refund, cancellation, or rescheduling may be available for no-shows, late arrivals, incorrect customer information, or requests made after the permitted cancellation or rescheduling window.

12. Delivery

Delivery timelines are estimates and may vary depending on gift type, delivery city, delivery address, partner availability, courier availability, logistics conditions, customer-selected delivery date, and customization requirements.

Digital products such as gift cards may be delivered through WhatsApp, email, SMS, platform message, or another supported digital channel.

Physical products such as flowers, cakes, hampers, personalized gifts, and other items are subject to vendor, courier, delivery, and logistics partner availability.

Wishkr is not responsible for delivery failure or delay caused by incorrect address, incorrect phone number, unavailable recipient, restricted delivery location, weather, courier delays, local restrictions, partner-side delays, force majeure events, or other circumstances outside Wishkr's reasonable control.

However, Wishkr will make reasonable efforts to help resolve delivery-related issues.

13. Cancellations, Returns And Refunds

Cancellations, returns, replacements, refunds, and delivery issues are governed by Wishkr's applicable policies:

Refunds, when applicable, are initiated to the original payment method and may take time depending on the payment gateway, bank, card issuer, UPI app, or payment method.

Wishkr may deduct payment gateway charges, partner cancellation charges, instant refund charges, or already-incurred fulfilment costs where applicable and legally permitted.

14. Third-Party Partners

Wishkr may use third-party partners for gift cards, products, hampers, customization, experiences, shipping, delivery, payments, communication, analytics, hosting, customer support, and fulfilment.

Third-party partner terms, brand terms, delivery terms, payment terms, and service-specific rules may apply in addition to Wishkr's policies.

Wishkr is not responsible for third-party delays, outages, errors, policy changes, stock issues, redemption restrictions, partner-side cancellations, or other matters outside Wishkr's reasonable control.

15. Communications

By using Wishkr, you consent to receiving communication from us through WhatsApp, email, phone, SMS, platform messages, or other supported channels.

These communications may include:

  • Order confirmations.
  • Payment updates.
  • Delivery updates.
  • Gift recommendations.
  • Support responses.
  • Service updates and announcements.
  • Promotional communication where permitted.

You may opt out of non-essential promotional communications by contacting Wishkr. Transactional and service-related messages may still be sent where required for orders, payments, support, or legal obligations.

16. Intellectual Property

All content on Wishkr, including but not limited to text, graphics, logos, icons, images, designs, layouts, software, brand elements, and platform content, is owned by Wishkr or its content suppliers and is protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, modify, publish, display, transmit, create derivative works from, or commercially exploit any Wishkr content without prior written consent.

17. Disclaimer Of Warranties

Wishkr is provided on an "as is" and "as available" basis.

We do not guarantee that Wishkr will be uninterrupted, error-free, virus-free, secure at all times, or free from technical issues.

We do not warrant the accuracy, completeness, availability, or suitability of any information, product, gift, recommendation, delivery estimate, partner service, or third-party content made available through Wishkr.

18. Limitation Of Liability

Wishkr will make reasonable efforts to provide a reliable gifting experience. However, to the maximum extent permitted by applicable law, Wishkr shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of or inability to use Wishkr.

Wishkr's total liability for any claim arising out of or relating to the services shall not exceed the amount paid by you to Wishkr for the specific order giving rise to the claim, or the amount paid by you to Wishkr in the 12 months preceding the claim, whichever is lower.

19. Indemnification

You agree to indemnify, defend, and hold harmless Wishkr, its founders, officers, directors, employees, contractors, partners, service providers, and agents from any claims, damages, losses, liabilities, costs, and expenses, including legal fees, arising from your use of Wishkr, violation of these Terms, misuse of the services, incorrect information provided by you, or infringement of any rights of another party.

20. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be limited or removed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

21. Force Majeure

Notwithstanding anything contained in these Terms of Use, the parties shall not be liable for any failure to perform an obligation under these Terms if performance is prevented or delayed by a force majeure event, including but not limited to acts of God, war, riots, civil unrest, government actions, pandemic, epidemic, fire, flood, earthquake, strikes, lockdowns, courier or partner failures, internet outages, or any other cause beyond the reasonable control of the parties.

22. Governing Law And Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India.

Any disputes arising under or relating to these Terms or Wishkr services shall be subject to the exclusive jurisdiction of the courts located in Pune, Maharashtra, India.
